I would like to share some of the tricks and traits of an unscrupulous tenant I recently experienced. Would love to hear some of your experiences to keep ahead of their game. In December 2009 a tenant moved in to a rental unit of mine. The deposit was paid via a cheque which reflected, but did not clear. It was to late as the tenant was already in. His first excuse for non-payment was that he had made an electronic transfer – from a bank other than mine - which would only reflect 4 days later.
I had previously heard this electronic tranfer excuse and was immediately on guard. Four days later, I contacted him only to find out the he had transferred the money into the wrong bank account. (this excuse was a new one to me). He and the bank were now trying to sort out the mess. It would take about a week.
He then undertook to borrow money – which would take another couple of days - to make the rental payment. I followed up, only to sadly hear that he was sadly hi-jacked with all his money stolen. He even had a police report to attest this. (also a new one to me, but Im told its an old trick) Talk about 'bad luck".
Having now long smelt something fishy, I immediately issued him with a Letter of Demand. Then issued a letter cancelling of the lease 7 days later. He now refused to vacate the premises. I then learnt he was a professional at this and was merely buying time with his excuses to live rent free. He informed me that he knew I could do nothing to him until I got an eviction order. And even then he would have a grace period to find a place.
I could only contact an attorney early in the new year. I’m glad I acted early on the letter of demand and cancellation of the lease. That had saved us lots of time or we would have had to follow that whole 7 day process. Having a water tight contract really helped - this guy was even looking for loopholes in the contract.
He was issued with a summons last week and mysteriously vacated the unit over the weekend. Look out for him on TPN, he will be shortly blacklisted.

1. We never allow anyone to move into a property unless all monies have been paid in cleared funds.
2. We warn tenants in advance that cheques take 7 days to clear.
3. Watch out for tenants providing proof of EFT payments from banks - they can create these themselves. We always insist on the email confirmation coming direct from the bank.
Why wasn't he blacklisted 20 working days after you issued the letter of demand?
