We are renting a house from 01 May 2010, and have recently discovered that there are fleas inside the house. We have also found Termite droppings, evidence that there is an infestation. We are so badly bitten by the fleas, this has also become an embrassment as vistors are constantly bitten while visting. Who's responsible for this, and can the lease be terminated as I am sure that my furniture will soon be attacked by the termites.

I have also moved into a unit from 1 May 2010 and I have asked that they can send someone out to spray the entire place due to having cockroaches and silver moths every where and also got cheap quote’s for them. They informed me no they can’t. Is this responsibility on me or the owners?

Fleas and cockroaches, it is a sad fact that when the pets leave they forget to take their fleas a long with them and I would encourage all owner and agents to adopt a not pet policy when renting out property, save you a lot of pain later on.
Who is responsible, I hold the owner responsible to see that the property is in a suitable condition for habitation. You would have to look at your Agreement to Lease to see what is stated in the Agreement to Lease, in my own I have a clause which states that if they did have a pet in the property that I can do two fumigations for fleas, one when they move out and one 6 weeks later to kill all the fleas. If there is not clause in the Agreement to Lease to cover this, I would approach the owner and if he is not interested, then approach the Housing Tribunal for a ruling, as you have a right to have the Fleas removed, or get a pet that the fleas can live on besides you.
The owner can also claim damages from the previous tenant if the fleas are a result of the pervious tenant having pets in the property.
Cockroaches, this is because the pervious tenants were dirty, or left food laying round, the way that I handle this, is that the outgoing tenant or owner pays to eradicate the first time, from then on it would be to the present tenant.
When doing a incoming inspection, you as the tenant want to check very careful for eggs, a good place to look is pull out the bottom draw take it right out and look at the back, this is where you will most likely see the eggs and the cockroaches, and that is the time to bring it to the owners or agents attention and to insist on fumigation to their account, and to make sure that it is recorded on your incoming inspection.
