Can a landlord put a leased property on show for sale.

A landlord can sell his property anytime during the lease. He would have to arrange a reasonable time with the tenant for showing the property to prospective buyers. However, if the property is sold, the new owner must honour the terms of the lease and the tenant does not have to vacate the property until the lease ends.

What is a reasonable time period to show the prospective buyers? The last month of the lease!

I would say any time you wish to sell. Maybe you sell to an investor who is happy to take over your tenant.

Thanks! However, I am the tenant. I'd like to know what reasonable amount of months ahead of the expiry of my lease, am I allowed to allow the "intrusion" of estate agents and prospective clients. My lease expires 31 Dec 2010. The Landlord wants to put it on the market from September, so I will have four months of intrusion of space. I did annotate on my lease that they can only have show houses in the last month, and no more than two in that month. Can I "advise" them I will allow the last month to be available for viewing/on the market, being that it is also the month that serves as my notice of lease expiry?

As per the other thread... They can market it when they like, but only show it as per your agreement in the lease (last months only). I doubt that anybody will be insisting to see it from day one when marketing started.

I agree with Marcl. Your terms signed in the lease agreement will determine when show days are allowed. The landlord can put the property on the market prior to the last month, but this must be balanced with the tenant's right to peaceful and undisturbed use and enjoyment of the property. You could approach the Rental Housing Tribunal if you feel the landlord's access to market the property is unreasonable.
