Why does the council want you to evict the tenants?

They say that the property is zoned single residential and therefore has to be rezoned to general residential. however it takes +-3 years to get rezoning so property must be empty while i wait for rezoning.

You should have sub divided it with prior permission. I suggest legal advise as to whether council can force you to give notice to tenants. I doubt eviction is required or reasonable. Maybe offer council to pay estimated rates on this part of the erven, but then your rates on remaining rates must come down too. Should not change much other than a second refuse charge maybe and a higher municipal value fro combined 2 erven as instead of one. I am guessing here. Ask a property lawyer or simply ask council for the legal grounds of their demand - in writing. Then you can still see a lawyer.
