hi there Michelle

i hope you can help me with this.
i entered into a lease agreement in January 2011. i unfortunately expereinced poor service since the beginning of the lease. i should also mention that they advertised the property incorrectly, however i was desperate and decided to give them my business provided they installed a shower as soon as possible. this did not happen. in October 2011 i was contacted by them and they informed me that i would either have to renew the lease or move out as the lease is nearing its expiration date (12 months). at that time i already begun looking elsewhere and asked if we could arrange a month to month lease which they did not want. so i eventually found a place and gave notice in 20/11/2011 to move out during December. on the 3/12/2011 the inspector came by to view the place and was more than satisfied with the condition. upon dropping off the keys later on that week, i was told i would be refunded my deposit 7 to 30 working days as of then. it is now 06/01/2012 and i havent received anything. i have contacted them via email and telephone most of last month to remind them about the deposit as well as yesterday to enquire about the delay. they could not give me a definite answer. late yesterday afternoon i received a mail saying that an inspector was sent through during the xmas period in December and due to the festive season they had experienced delays and that the 7 to 31 day waiting period for the deposit started at the end of December 2011. please advise.

The refunding of a deposit is very clearly regulated in the Rental Housing Act. If there are no damages the full deposit must be paid back within 7 days. The December holidays are no excuse for a delay in repayment. The Rental Housing Tribunal is available to tenants to log a dispute in such cases.
