I wonder if some can tell me if the regulations in Durban are the same as in Jhb with regard to Incoming Inspection.



I have relatives who are having trouble with their landlord/agent in Dbn. My properties are all in Jhb and I know the rules that apply to me here.

They were on a month to month lease, and gave notice when they were told that the maintenance issues they were reporting would not be seen to due to the fact that the property would be going up for auction.

When they moved in, no incoming inspection was performed, and the landlord / agent has failed to attend to any of the maintenance issues they've reported over the years.

The agent is now telling them that their deposit will probably all be kept, to pay for the "damages" since the unit is in such terrible condition.

Is it my understanding that if an Incoming Inspection is not performed by the agent and tenant together, then the deposit cannot be used for damages. Do they follow different rules down in KZN?
