According to the Occupational Health and Safety Act, 1993 that no property may be marketed, rented or sold without a valid Electrical Certificate of Compliance (CoC) must be issued by a registered electrician. A registered electrician must be registered with the Electrical Wireman’s Board and renew the registration every year. A valid CoC is issued by a qualified registered electrician, it cannot be older than years, if any work is done to the system during the period for wich the certificate is issued, a CoC has to be issued for that part of the installation where changes were made and not re-issue a complete CoC. Many Estate Agents and Managing Agents are not complying with the act or quite simply do not understand it. THEY ARE ONLY CALLING FOR THE COC WHEN THE LEGAL SIDE OF SALE TRANACTION NEEDS TO BE COMPLETED.THIS IS WRONG! The CoC forms a part of the property transaction process, however the act is quite clear that any user of a electrical system is responsible for the safety of the electrical installation and therefor must have a valid CoC on the property, AT ALL TIMES. In a sectional title scheme the same applies to the “common” property, this CoC held by the trustees. These must be the original CoC’s. When the property is sold the transferring attorney will call for the CoC for registration, however this must be returned to the property. I cannot stress the importance of a CoC being on the property at all times. Should a property be advertised for sale or rent the Department of Labour will prosecute if they find due process was not followed. A number of electricians are complaining about getting urgent calls to complete a CoC as the sale process is being held up, such cases should be reported to the Department of Labour, however there are some electricians that will do anything even if it is illegal.

As an estate agent, I have a hard time getting the sellers to understand the regulations of the CoC. As not all sellers are up to date with the laws, that is why estate agents are called in for marketing their property. Still, they do not fully trust our knowledge! Some are still under the impression that the CoC that was issued some 15 or 20 years ago, are still valid. I have to add though: some sellers do appreciate our help, and do trust our knowledge. Believe it or not, there is still some loyal customers out there. I am lucky to have quite a few.
