I have had R2600 worth of toilet/gas detection repairs on my two properties. I understand as the Landlord that I am responsible for the cost of underground leaks (gas detection and repairs). However, there were toilets that were overfilling or broken, and who is responsible for those repair costs?
1. Tenant has been there just over 2 years, toilet overfills, needed repairs - who pays? 2. Tenant has been there just over 4 years, toilet needed replacement stopcock/ball valve- who pays? 3. Tenant has been there 5 months, toilet ball socket needed replacement - who pays? 4. Tenant has there 18 months, and maids room geyser (which they also use), needed thermostat, pressure valve and temperature control valves - who pays? 5. Tenant is running a mini bakery from the garage, and the waste water needs to be diverted from the (illegal) storm water soak pit to the sewer. Who pays?
We have been able to claim on water insurance for the cost of the water, but the repairs have been exorbitant.

1-4 owner pays. 5 tenant pays.

Yes...Perfect! I am certainly agreed with above advice.
Home owner can pay 1 to 4 and 5 could be paid by you.

I tend to agree 1.4 owner pays unless he can prove tenant is at fault or grossly negligent It also depends what the lease says. Overfilling cistern (not toilet) sounds like a wear and tear rubber item (I just bought one for R6.00 today). Learn how to replace it. Much cheaper than calling a plumber.
5 definitely tenant pays.
You may want to check the legality of running a business there.
