Hi, My landlady has not invested my deposit (am 99% certain) and I have asked her for official proof that it has been invested. She has provided a handmade receipt that payment has been received but I have told her that I want an "official" proof of investment, not proof of payment eg. bank statement of account where my deposit has been lodged or an account number. We are going to the tribunal next week for her intimidation but I want to have my facts straight. I lodged the R20000 into her bank account using online banking.
The Unfair Practice Regulations in Gauteng provides, in section 11(2) thereof, that a landlord must furnish a receipt “even where payments are made into his or her banking account and where a deposit slip exists as proof of payment or where any other method of payment is used as agreed upon by the tenant and landlord”
My question is whether she can be forced to show written proof that my deposit has been invested?

The act says "the landlord is then obliged to provide written proof of the accrued interest to the tenant upon request". So I should be able to say 'your handmade receipt is not written proof. I want an official statement from the institution where the deposit is invested to show the interest". Am I correct to state this and expect her compliance legally?? edited by DaveColeman on 2011/11/11

My 5 cents: If an owner opens a new account just for the deposit the bank fee will probably erode any below inflation interest you are getting. makes bank richer and gives you little interest. I would not worry to much about it at this stage as long as you have proof that you paid the deposit. Then at lease end you claim it back with interest (assuming there are no damages of course). Then she has to give you the interest calculation too. I am sure many ownewrs might use that money which is legally not right. But as long its available when due to paid back who cares?
