Hi All

I wonder if someone might be able to give me some advise with regards to a landlord, who is a client of mine.

Basically the owner signed a mandate with us to lease her house for a certain rental for a period of one year. we succesfully found a suitable tenant, who was accepted by the landlord, however the landlord changed her mind with regards the period and now only wanted a 6 month lease (basically halving our commission, but thats not the problem) we and the tenant agreed to the 6 month lease, the tenant signed the lease and paid first months rental as well as deposits. As per usual we deducted our commission and paid the balance over to the landlords account and submitted the signed lease to the landlord for signature (this was all earlier this month, for occupation 1st December).

We have been asking the landlord for the countersigned lease for over a month now and today she comes back to us saying that she has accepted an offer to purchase the property and now wants to change the lease to a 3 month lease. Obviously the tenant is not happy with this because they dont want to have to move again in 3 months time.

What are our options here?

What lease period was stated in your mandate to let?
And how was it agreed to change that? Owner cannot change it willy nilly especially after a tenant had been found. Owner can be lucky that tenant agreed to 6m after 12m was the target.

Why does your mandate not empower you to sign the lease? Once signed owner has to stick to notice period if any.
