Hi, our tenant has given us notice to cancel the lease at 31 January (Early termination). In terms of our agreement we are entitled to 1 month's rent as a penalty if we cannot get new tenants by the 31st.

The tenant stayed in the apartment with her boyfriend. (Lease was only in the tenant's name).

The tenant and her boyfriend broke up and she moved out. The boyfriend is still staying in the apartment. He is making it extremely difficult for us to bring potential tenants over to view the place. He is also asking to take over the lease, but he is expecting to keep his girlfriend's deposit.

What should we do in this situation? We technically don't have an agreement with the boyfriend and the girlfriend has terminated her lease.

Ask the boyfriend to apply as any other applicant. If he gets approved and pays the deposit he can stay on. He has no stake in the deposit paid by his ex girlfriend. He cannot take over a lease just like that.

If he just stays on regardless he is an illegal occupant as I assume he is not a named occupant on the girlfriends lease.
