Hi Michelle

I rented a property to a tenant approx. 7 years ago and did initial inspection and held deposit in trust. Owner took over and now they have moved, owner is handicapped and she asked me to conduct final inspection. I thought property was ok besides fair wear and tear which is normal considering the time spent in the unit. The owner went in after she said she could not and is not happy with certain things and wants to use deposit to repair. Tenant has agreed to certain things and not others and both are unrelenting. I am now stuck in the middle holding the deposit. Legally what are my obligations regarding the deposit. I have been told to hold onto it until they have resolved their dispute, is this correct?

Difficult. Usually give and take. If it cannot be resolved let the Housing Tribunal clear it, but hold on to the deposit until resolved.

Just saw now that owner took over. Since lease is in owners name I would simply pass deposit plus interest to owner and then they can trash it out amongst them. Why would you still want to be involved? You gave your opinion.
