Hi.
My previous tenant vacated the property on the 30 Sept 2011, without settling his municipality debt and costs for damages to the property. He stated that the deposit be used for the last month's rent and promised to pay the Municipality bills but to date this has not happened. 2 Legal Letters and an email have been sent requesting such monies be paid up but to no avail. The tenant does not respond to any communication. I do not know his physical address but registered letters were sent to his business address. All we want is for him to pay his dues. Please advise.

Never allow the deposit used to be as rent. A common abuse. Its there for damages like unpaid bills.

Send him a Letter of Demand (see TPN) and announce black listing if not paid within 7 days. Attach a statement documenting what he owe's referring to the lease clause which says that he liable for such costs. If possible hand deliver the letter at his workplace. Make sure you do it loudly so all around can hear what it is about. That might embarrass him enough to pay up. Obviously do not give your real name when you ask at reception to see him.
